Legal Age and Possession

Firstly, only adults over the age of 21 (18 and older if you are a medical cannabis patient) are legally permitted to possess, consume, and purchase cannabis in Chicago (and Illinois in general), effective January 1, 2020.

Where Can You Consume Cannabis in Chicago?

Cannabis consumption is allowed in two primary places:

  • Licensed Premises: Entities with an on-premises consumption license.
  • Private Property: Subject to the property owner’s discretion.

However, public consumption remains illegal.

This includes streets, parks, areas adjacent to licensed dispensaries, and any location where a person could reasonably be expected to be observed by others.

Vehicle Regulations

Cannabis consumption in any vehicle, whether moving or stationary, is prohibited. Operating a vehicle under the influence of cannabis is illegal.

Cannabis must be stored in a child-resistant container and be inaccessible in a moving vehicle.

Interstate Transportation

Cannabis purchased in Illinois cannot be transported to another state.

Purchase and Possession Limits

Licensed dispensaries operate between 6 a.m. and 10 p.m.

Possession limits vary for residents and non-residents:

  • Cannabis: 30 grams for residents, 15 grams for non-residents.
  • Cannabis-Infused Products: 500 milligrams of THC for residents, 250 for non-residents.
  • Cannabis Concentrate: 5 grams for residents, 2.5 grams for non-residents.

Additional Restrictions and Limitations

  • Prohibited Conduct: Engaging in tasks under the influence that constitute negligence or misconduct, possessing cannabis in prohibited locations like school buses, correctional facilities, public places, or vehicles (unless secured and inaccessible), and using cannabis in close proximity to anyone under 21 years old who is not a registered medical cannabis patient are prohibited​​.
  • Businesses’ Rights: Private businesses can restrict or prohibit cannabis use on their properties, including parking areas​​.
  • Driving Under Influence: Arrest or prosecution for reckless driving or operating vehicles under the influence of cannabis is enforceable if probable cause exists​​.
